1. General Provisions
1.1. This User Agreement (hereinafter referred to as the “Agreement”) is concluded between the User and Flexcard.cards (hereinafter referred to as the “Service”).
1.2. Acceptance of this Agreement occurs upon the User’s registration on the website https://flexcard.cards/ (hereinafter referred to as the “Site”).
1.3. The Flexcard.cards Service available on the Site provides a technical solution for:
- issuing virtual payment cards used exclusively for advertising purposes in advertising networks;
- replenishing the User’s account within the Service.
2. Responsibility of the User
2.1. The User is solely responsible for the accuracy of all information provided during registration.
2.2. All Users belonging to the same team, including related accounts, share equal responsibility for any actions performed while using the Service.
2.3. The Service does not verify the accuracy of data provided by the User, except when such verification is required by law or necessary for the provision of services.
2.4. The User is solely responsible for the content of advertisements placed in advertising networks.
2.5. The Service is not responsible for the operation, quality, or performance of advertising networks, including any errors, delays, holds, suspensions, or restrictions arising during advertising placement.
2.6. The Service is not responsible for any unlawful actions of third parties aimed at unauthorized access to or disabling of the Service.
2.7. The Service is not responsible for any losses resulting from the User’s disclosure of login credentials, card details, or security codes to third parties. Any actions performed from the User’s account shall be deemed performed by the User.
2.8. The Service has the right to send informational or promotional messages to registered Users. Users may opt out by sending an email request to support@flexcard.cards.
2.9. The trademark, logo, and abbreviation “Flexcard” are the intellectual property of the company. Unauthorized use, reproduction, or registration of these marks as part of another entity’s name is strictly prohibited.
3. Definitions
3.1. Service – the online platform Flexcard.cards providing virtual card issuing and account management functions.
3.2. Advertising Networks – online platforms or systems that manage advertising placement and determine pricing and requirements for ads.
3.3. Account (personal account) – the User’s personal section on the Service created upon registration.
3.4. Credentials – the login and password chosen by the User for accessing their Account.
3.5. Balance – a non-bank electronic account opened by the Service for the User, reflecting all transactions and available funds.
3.6. Positive Balance – sufficient funds available for advertising spending.
3.7. User – an individual registered and assigned a unique User ID.
3.8. Team – a group of Users with interconnected accounts sharing equal responsibility for Service usage.
3.9. Service Administration – the personnel managing and maintaining the operation of the Service.
3.10. Ticket – an electronic support request describing issues or errors in the Service, submitted via the feedback system or to the support email.
4. Subject of the Agreement
4.1. The Service provides Users with the technical means to issue virtual payment cards and fund advertising campaigns in advertising networks, including but not limited to Meta (Facebook, Instagram), Google, and TikTok.
4. Subject of the Agreement
4.2. For the purpose of advertising placement, a virtual card is issued to the User, showing the amount of funds available for spending in the currency of the BIN on which the card was issued, as pre-set by the User during the card request process.
4.3. All Users of the same team are equally responsible for the use of the Service.
4.4. The Service can be used only with a positive balance.
4.5. Exploiting vulnerabilities, engaging in fraud, or using unpaid bills or similar schemes is strictly prohibited and will result in account termination without refund.
4.6. The minimum balance required to issue a card is 50 USD.
4.7. The number of cards per User is unlimited.
4.8. The number of cardholders per User is unlimited.
4.9. The maximum spend per cardholder is unlimited.
4.10. The maximum spend per User is unlimited.
4.11. The base top-up commission is from 3%, depending on the deposit amount and total spending volume.
4.12. Card issuing fee ranges from 2 to 4 USD or EUR, depending on the type of card and current pricing at the time of issuance.
4.13. Card limits may be adjusted free of charge.
4.14. Account top-up is available via USDT (TRC20), USDT (ERC20), or wire transfer.
4.15. To stop using the Service and request a refund, the User must contact Support directly, as refunds are processed manually.
4.16. Prohibited advertising topics include:
- human trafficking;
- child pornography;
- illegal substances (including pharmaceuticals and adult “nutra” products);
- weapons of any kind;
- malware or malicious software installations.
5. Financial Conditions
5.1. The User forms a balance by depositing funds through payment systems specified on the Site.
5.2. The User may fund any amount not less than the minimum limit (50 USD / 50 EUR). The Service reserves the right to change this minimum limit. If the deposit is below the minimum limit, the Service reserves the right to reject the transaction and not provide Services.
5.3. Refunds are initiated upon the User's electronic request via the feedback system or support email.
5.4. Refunds are available only if the total balance across all team accounts is non-negative.
5.5. Refunds are issued minus payment system fees related to the refund transaction.
5.6. Refunds are made using the same method as the original deposit. Cash refunds are not possible.
5.7. Refunds to third parties are not available.
6. Rights and Obligations of the Parties
6.1. The User has the right to terminate this Agreement by notifying the Service 30 (thirty) days in advance.
6.2. The User is obliged to:
- Use the Service only within the limits and methods specified in this Agreement;
- Independently resolve any claims or demands of third parties related to the payment solutions issued through the Service.
6.3. The Service has the right to:
a) Terminate this Agreement unilaterally, with 5 (five) days' prior notice;
b) Modify this Agreement unilaterally by publishing a new version on the Site;
c) Suspend or terminate the User's account in the following cases:
- Violation of clauses 4.5 or 4.16 of this Agreement;
- Decline rate exceeding 20%;
- Connection to or association with another blocked account;
- Detection of fraudulent or abusive activity.
In such cases, the User is not entitled to refunds or reimbursements.
6.4. The Service undertakes to:
- Provide access to the Service daily and around the clock, except for maintenance periods not exceeding 24 hours per month;
- Provide support and information through the feedback form or via email;
- Inform Users of Service updates;
- Promptly fix technical malfunctions, if technically possible and if the issue was not caused by the User.
7. Cryptocurrency Transactions
7.1. Users must send cryptocurrency only to wallet addresses explicitly indicated on the official website or in the User's dashboard.
7.2. Wallet addresses may change from time to time. The Service bears no responsibility for funds sent to outdated or incorrect wallet addresses, or to any third-party wallet.
7.3. Such transactions are considered irreversible and non-refundable.
8. Other Conditions
8.1. This Agreement is valid indefinitely.
8.2. All disputes and disagreements shall be resolved via email correspondence between the User and the Service.
8.3. The Parties agree that disputes fall under the jurisdiction of the location of the Service.
8.4. The Service may, when technically possible, perform backup or storage of User data.
8.5. This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements, representations, or understandings, whether oral or written.
